Real Property Foreclosures

The real estate lawyers at McConnell Wagner Sykes + Stacey, PLLC have extensive experience foreclosing properties and defending our clients against real property foreclosure actions. Our firm is one of very few law firms in the state of Idaho that have been involved in all aspects of the judicial foreclosure process from beginning to end including: sending notices of default, foreclosing real property at trial, credit bidding to purchase real property at a foreclosure sale, guiding clients through the redemption and re-redemption processes; and defending foreclosure proceedings on appeal.

Under Idaho law, lenders may only record a deed of trust against property located outside of an incorporated city if it is 40 acres or less in size. Mortgages are used to secure amounts owed to lenders when the property securing the loan is greater than 40 acres. Title companies can typically help lenders non-judicially foreclose deeds of trust. Mortgages must be foreclosed judicially in a court of law located in the same county where the property being foreclosed is located. The real estate lawyers at MWSS+ can help you thru every aspect of the judicial foreclosure process.
