Under Idaho law, lenders may only record a deed of trust against property located outside of an incorporated city if it is 40 acres or less in size. Mortgages are used to secure amounts owed to lenders when the property securing the loan is greater than 40 acres. Title companies can typically help lenders non-judicially foreclose deeds of trust. Mortgages must be foreclosed judicially in a court of law located in the same county where the property being foreclosed is located.
